1. Operator and acceptance

The Canadian HomeBook website is operated by HOMEBOOK RESIDENT EXPERIENCE SOLUTIONS INC., incorporation number BC1555130, of Unit 324, 275 Alexander St, Vancouver, BC V6A 1C2.

These terms apply to the public Canadian website at home-book.ca. By accessing or using it, you agree to these terms. If you use the website for an organization, you confirm that you are authorized to do so on its behalf. If you do not agree, do not use the website.

2. Marketing website only

The website provides general information about HomeBook and its proposed or available capabilities. It is not a customer contract, service-level commitment, binding proposal or offer to provide services.

Submitting an enquiry or booking a demonstration does not create a customer, advisory, fiduciary, partnership or agency relationship. Any HomeBook platform deployment is governed by a separately signed agreement. If that agreement conflicts with these terms, the signed agreement controls.

3. Permitted use

You may use the website for lawful personal or internal business-evaluation purposes. You must not:

• Attempt unauthorized access to the website, systems or data.
• Interfere with operation or security, bypass technical controls or introduce malicious code.
• Use automated means to scrape, harvest or extract website content or data without written permission.
• Misrepresent your identity or submit false, unlawful or abusive material.
• Use the website unlawfully or to infringe another person’s rights.
• Copy, modify, distribute, resell, reverse engineer or commercially exploit website content except with written permission or as permitted by law.

4. Content, illustrations and outcomes

We may change website content, features and availability without notice.

Descriptions, illustrations, workflows, results and metrics are provided for general information. They are not guarantees that the same functions or outcomes will apply to every project. Actual outcomes depend on the agreed implementation, configuration, data, processes, baseline and customer participation.

You should evaluate HomeBook against your own requirements and obtain appropriate professional advice before making a procurement, legal, financial or operational decision.

5. Intellectual property

The website and its content, including text, designs, graphics, videos, software, trademarks and logos, are owned by or licensed to HomeBook and are protected by applicable intellectual-property laws.

No ownership or licence is granted except the limited, revocable right to access the website in accordance with these terms.

6. Feedback and submissions

If you voluntarily provide product feedback or suggestions, you authorize HomeBook to use them without restriction or payment, provided that this does not transfer ownership of your confidential information or personal information. Personal information is handled under our Privacy Policy.

7. Third-party services and links

The website may link to services operated by third parties, including Calendly. Third-party services are governed by their own terms and policies. HomeBook does not control and is not responsible for their content, availability or practices.

8. Privacy

Our collection and handling of personal information through the Canadian website is described in our Canadian Privacy Policy and Cookie Notice.

9. Confidential information

Do not submit confidential, commercially sensitive or personal information that is not necessary for your enquiry. Unless HomeBook has agreed otherwise in writing, information submitted through the public website is not treated as confidential.

10. Website availability and warranties

To the fullest extent permitted by law, the public website and its content are provided “as is” and “as available”, without warranties concerning uninterrupted availability, error-free operation, completeness, accuracy, non-infringement or fitness for a particular purpose.

Nothing in these terms limits an express obligation in a separately signed agreement or any right or liability that cannot legally be limited.

11. Liability

To the fullest extent permitted by law, HomeBook and its directors, officers, employees and contractors are not liable for indirect, special, incidental, punitive or consequential loss arising from use of, inability to use or reliance on the public website, including lost profit, lost opportunity, lost savings or lost data.

Nothing excludes liability that cannot legally be excluded or limits any mandatory right available under applicable law.

12. Suspension and termination

We may restrict or suspend access to the website where reasonably necessary to protect the website, HomeBook, users or third parties, to investigate misuse or to comply with law.

13. General terms

If any provision is found unenforceable, the remaining provisions continue in effect. A delay in enforcing a right is not a waiver. These terms, together with the documents expressly incorporated by reference, form the entire agreement concerning use of the public website and do not replace a separately signed customer agreement.

14. Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada applicable there. Subject to rights that cannot legally be restricted, disputes concerning the public website will be submitted to the courts of British Columbia sitting in Vancouver.

15. Changes and contact

We may update these terms prospectively by posting a revised version and updated date. The version in effect when you use the website applies to that use.
